The Chief Magistrate Court in Kisoro District has dismissed a civil suit in which, Chief Executive Officer and Proprietor of Hope for Orphans and Vulnerable Children (HOVC) Innocent Ndagijimana Sued Former Bishop of Muhabura Diocese Cranmer Mugisha and two others for illegally conducting activities under a proxy arrangement that eventually crippled his Charity Organization.
HOVC collapsed after Edge Uganda Incorporated, formerly HOVC Australia was set up in May 2011 to support Orphans and Vulnerable Children in Kisoro District.
Australian funders, Marion Pendlebury and Steve Moore, working closely with then, Bishop Cranmer Mugisha took over the operations of the charitable Organization following an audit that revealed series of financial discrepancies including alleged fraud and gross misrepresentation.
A Judgment was presented yesterday at the Chief Magistrates Court, on behalf of His Worship Raphael Vueni who was recently transferred.
Ndagijimana filed the suit against the three parties jointly seeking court’s declaration on the activities as being affiliated, associated and connected with his CBO, Hope for Orphans and Vulnerable children-Kisoro which was duly registered and licensed to operate in Kisoro district.
The magistrate, in his judgment said it is not clear on record whether Bishop Cranmer’s alleged acts are for individual or for the church as an entity.
The Judgment recommends that Innocent Ndagijimana should have sued the registered trustees of the Diocese of Muhabura and not Bishop Cranmer Mugisha as an individual.
The statement further says Steve Moore and Marion Pendlebury were wrongly sued because they are simply workers of Hope for orphans and Vulnerable Children Australia
The case was dismissed from Court without costs from either party.
Several beneficiaries from Edge Uganda thanked the Court for its deliberations on the matter.
