Nyabwishenya Sub County threatens to take district to court over 66 Million Court fine.

Barihafi, now believes his only course of action is to sue the district because they are partly responsible for the mistakes that were made.

Nyabwishenya Sub County in Bufumbira North, Kisoro district is currently grappling with a crippling court fine of 66 million shillings that was incurred after losing a court case to an individual identified as one ‘Bishaka’

This was confirmed by the Nyabwishenya LCV Councilor Barihafi Ponsiano.

Barihafi says the Sub County illegally installed water pipes on Bishaka’ 30-acre property without consulting him.

Bishaka pursued his constitutional rights, filing a civil case at Kabale high court which saw him awarded in 66 million shillings, in compensation.

According to Barihafi, Bishaka’s patience has been running thin after the Sub County authorities declared that they do not have enough finances to cover the fine.

Barihafi says they sought financial support from Nkuringo town council (formerly part of Nyabwishenya Sub County) but it has all been in vain.

“In our time of need, Nkuringo town council has turned its back on us. They should come to our aid because they were part of us when things went wrong”, Barihafi explained

Barihafi, now believes his only course of action is to sue the district because they are partly responsible for the mistakes that were made.

Kisoro district currently has 13 unresolved court cases against it, most of them revolving around land issues.

Bishaka says he has been waiting for his dues for the last three years, with leaders playing cat and mouse with him.

He says he feels like he is being taken for granted.

Bishaka says he needs to see some form of commitment from the Sub County leadership in paying his money.

Nkuringo town council Mayor Atanazio Kajibwami says his administration has never been formally approached.

Kajibwami adds that if they choose to write to Nkuringo town council, little can be done because Nkuringo is now an independent unit of administration and Nyabwishenya cannot demand anything from them.
